2. Purpose and scope
These Terms and Conditions of Sale define the rights and obligations of Blaspo and its customers for online sales of products offered on blaspo1990.com. They apply to all orders placed by consumers on the website.
Before confirming an order, customers acknowledge that they have read these terms, the Shipping Policy, Refund Policy and Privacy Policy. Confirming the order implies acceptance of the terms applicable on the purchase date. Mandatory statutory consumer rights remain applicable in all circumstances.
3. Products and essential characteristics
Blaspo sells, among other items, video games, DVDs, Blu-rays, CDs, books, decorative stickers, figurines, toys, collectibles, household products, accessories and high-tech products.
Each product page presents its essential characteristics, including where relevant: its name; condition (new, second-hand, refurbished or another clearly specified condition); main features; compatibility; language; dimensions or format; included accessories; defects, missing elements or signs of use; and any specific conditions or restrictions.
Customers must carefully read the product page before ordering. Photographs aim to show the product as faithfully as possible. Unless expressly identified as an actual contractual photograph of the item sold, slight differences in appearance or colour may occur depending on the screen, manufacture or selected variant.
4. Product availability
Products are offered while stocks last. Some items are available in limited quantities or as single items, especially second-hand and collectible products.
If exceptionally a product becomes unavailable after order confirmation, Blaspo will inform the customer as soon as possible. Depending on the situation, customers may receive cancellation and a full refund of the unavailable item, an equivalent product proposal subject to prior agreement, or fulfilment of the remaining items where partial delivery is possible.
For cancellation due to unavailability, refunds use the original payment method as soon as possible and no later than 14 days after cancellation.
5. Prices
Prices are shown in euros and are the final consumer prices, excluding any delivery charges clearly disclosed before order confirmation. The applicable VAT regime is stated in accordance with Blaspo’s tax situation.
For deliveries outside the European Union, customs duties, import taxes or handling charges may be required by local authorities or the carrier. Unless otherwise stated, these remain the recipient’s responsibility.
Blaspo may change prices at any time. The invoiced price remains the price displayed and accepted when the order was confirmed, except in the event of an obvious pricing error. If an obvious error makes the price clearly inconsistent with the product’s usual value, Blaspo will contact the customer to propose correction or cancellation with a full refund.
6. Ordering process
To place an order, customers must select the product and variant, add it to their cart, check the contents and total price, enter billing and delivery details, select an available delivery method and payment method, check and correct their details if needed, accept these terms and confirm the order with an obligation to pay.
Customers must provide accurate, complete and up-to-date information. Once payment is validated, an order confirmation email is sent to the supplied address. A second email may be sent on dispatch with available tracking information.
Blaspo reserves the right to suspend or cancel an order in the event of refused payment, suspected fraud, clearly incorrect information or an unresolved previous dispute, in accordance with applicable legislation.
7. Payment
Available payment methods are those displayed at checkout and may include bank cards, PayPal, Shop Pay, Apple Pay, Google Pay or another method offered by Shopify at the time of payment.
Payment is securely processed by the payment providers offered on the website. Blaspo does not directly retain customers’ complete bank details. Orders are considered validated after payment confirmation by the relevant provider. Orders cannot be processed if payment is refused or incomplete.
8. Preparation and shipping origin
Depending on the product, orders may be prepared and shipped directly by Blaspo or by a supplier or partner responsible for fulfilment. Where necessary for delivery, recipient details are shared with the relevant supplier, logistics partner or carrier under the Privacy Policy.
Shipping origins and any specific delivery times are stated on the product page or in the Shipping Policy. Even where a supplier or partner physically prepares or ships the order, Blaspo remains the seller and responsible to the customer for proper fulfilment.
9. Shipping and delivery
Orders are generally processed Monday to Saturday, excluding public holidays. Usual preparation and dispatch take 2 to 5 business days after order validation.
Estimated transit times begin at dispatch:
- Mainland France: 5 to 8 business days after dispatch, giving a usual estimated total of 7 to 13 business days after ordering;
- French overseas territories and international destinations: 7 to 15 business days after dispatch, giving a usual estimated total of 9 to 20 business days after ordering.
Some products have specific times stated on their pages. Delivery is free in mainland France with no minimum order. International delivery starts at €8 and is calculated according to destination, weight and order characteristics. The final charge is displayed before payment confirmation.
Available destinations are those offered when entering the address at checkout. Detailed conditions on times, international restrictions, customs duties, delays, lost parcels and failed deliveries appear in the Shipping Policy.
10. Incorrect addresses and failed delivery
Customers must check their address is accurate and complete before confirming an order. If a parcel is returned due to an incorrect or incomplete address, unjustified refusal, repeated absence or failure to collect, Blaspo will contact the customer to offer reshipment or a refund according to the circumstances.
Reshipping costs may be charged where failure results from customer-provided information or an unclaimed parcel. If failure is attributable to Blaspo, its supplier, logistics partner or carrier, a solution will be offered at no additional cost.
11. Right of withdrawal and commercial returns
Under Articles L.221-18 et seq. of the French Consumer Code, consumers have a statutory right of withdrawal for 14 days from receipt of the goods without giving a reason. Blaspo commercially extends this period and accepts return requests within 30 days of receipt, subject to the Refund Policy.
Customers must inform Blaspo by a clear statement sent to contact@blaspo1990.com, or use the model withdrawal form in the Refund Policy. After communicating their decision, they must return the product according to the instructions received and applicable deadlines.
Customers bear direct return costs except for faulty, damaged or non-conforming products or errors attributable to Blaspo. Products must be returned complete with accessories and, where possible, original packaging. Customers may be responsible for diminished value caused by handling beyond what is necessary to check the product’s nature, characteristics and proper functioning.
12. Exceptions to the right of withdrawal
Under Article L.221-28 of the French Consumer Code, withdrawal does not apply in particular to:
- Products made to customer specifications or clearly personalised;
- Audio or video recordings and computer software unsealed after delivery;
- Sealed products unsuitable for return for hygiene or health protection reasons once unsealed after delivery;
- Digital content without a physical medium where performance has begun with express prior consent and express waiver of the right of withdrawal.
Proof of purchase or an order number may be requested to identify the transaction.
13. Refunds
For valid withdrawal, Blaspo refunds the product price and standard delivery charges originally paid. Extra charges for a delivery method more expensive than standard are not refunded.
Refunds are issued within 14 days of receiving the withdrawal request. For physical goods, Blaspo may withhold the refund until goods are received or proof of return shipment is provided, whichever occurs first.
Refunds use the original payment method unless the customer expressly agrees to another method without additional fees.
14. Statutory guarantees
Consumers benefit from the statutory guarantee of conformity under Articles L.217-3 et seq. of the French Consumer Code and the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.
The conformity guarantee may be invoked when a defect appears within two years of delivery for new, second-hand or refurbished goods. The period during which a defect is presumed to have existed at delivery is 24 months for new and refurbished goods and 12 months for second-hand goods.
After this presumption period, consumers may still invoke the guarantee within the statutory two-year period but must demonstrate that the defect existed at delivery.
Where the conformity guarantee applies, consumers may request repair or replacement free of charge, subject to statutory conditions. If repair or replacement is impossible, disproportionate, not completed within the statutory time or causes major inconvenience, consumers may request a price reduction or termination of the contract under statutory conditions.
The hidden-defects guarantee may be invoked within two years of discovering the defect, subject to the Civil Code’s conditions. To exercise a guarantee, contact contact@blaspo1990.com. Any recommendation to report visible damage promptly never limits statutory guarantee rights.

After a prior written complaint remains unsatisfactorily resolved, consumers may use Blaspo’s consumer mediator free of charge:

Mediation is optional for consumers and does not deprive either party of the right to bring the dispute before a competent court.
16. Liability
Blaspo remains responsible to customers for proper order fulfilment, including when preparation, dispatch or delivery is entrusted to a supplier, partner or carrier.
Blaspo cannot, however, be held responsible for indirect damage arising solely from website use or temporary interruptions caused by maintenance, unforeseen events or legally recognised force majeure.
Blaspo is not liable where non-performance results exclusively from a customer’s fault, particularly an incorrect or incomplete delivery address, subject to mandatory consumer rights.
Nothing in these terms limits or excludes consumers’ right to proper fulfilment, statutory guarantees, withdrawal rights, applicable liability for non-conforming, faulty, dangerous, lost or late-delivered products, or other mandatory statutory rights.
17. Intellectual property
Content created by Blaspo, including its trading name, logo, original texts and own creations, is protected by intellectual property rules. Unauthorised reproduction or use is prohibited.
Trademarks, logos, photographs, illustrations and other elements belonging to manufacturers, publishers, suppliers or third-party rights holders remain their respective property. Their presence merely identifies or presents the relevant products and does not imply any official affiliation, authorisation or partnership unless expressly stated.
18. Personal data and cookies
Personal data is processed under the GDPR, the French Data Protection Act and Blaspo’s Privacy Policy. This policy explains collected data, purposes and legal bases, recipients, retention periods, possible international transfers, individuals’ rights and cookie use. Customers can exercise their rights at contact@blaspo1990.com.
19. Force majeure
Neither party is liable for delay or non-performance resulting from force majeure recognised under French legislation and case law. The affected party will inform the other as soon as possible and take reasonable measures to limit consequences.
If the impediment becomes permanent or lasts beyond a reasonable time, statutory rights, including cancellation and refund where applicable, remain preserved.
20. Applicable law and competent courts
These terms are governed by French law without depriving consumers of mandatory protections under the law of their country of residence where applicable.
An amicable solution will be sought first. Consumers may then use the identified consumer mediator free of charge. If no amicable resolution is reached, disputes may be brought before the competent court under applicable legal rules. Nothing in these terms requires consumers exclusively to use the court of Pontoise.
21. Changes to these terms
Blaspo may amend these terms to reflect legal, regulatory, technical or commercial developments. The terms applicable to an order are those accepted at confirmation. Subsequent changes do not apply retroactively to orders already concluded.
